Historic Preservation and Section 106 Review
Section 106 of the National Historic Preservation Act of 1966
as amended requires consideration of historic preservation by any Federal agency
funding, licensing or permitting a project. For example, an ethanol project
might receive direct assistance as a grant or a loan, or might be required to
obtain a 404 permit from the U.S. Army Corps of Engineers. Compliance with Section
106 is the responsibility of the agency, but agencies do have the authority
to delegate this responsibility to the applicant or recipient.
